Introduction:

  • Bidders shall adhere to all the requirements of this RFQ.
  • Any Bid submitted will be regarded as an offer by the Bidder and does not constitute or imply the acceptance of the Bid by RUD. RUD is under no obligation to award a contract to any Bidder as a result of this RFQ.
  • RUD reserves the right to cancel the tendering process at any stage without liabilities

Only one Bid:

  • The Bidder shall submit only one Bid.
  • Bids submitted by two (2) or more Bidders shall all be rejected if they are found to have any of the following:
  • They have at least one managing partner, director or shareholder in common;
  • They have a relation with each other, directly through common third parties, that puts them in a position to have access to information about, or influence on the Bid of, another Bidder regarding this RFQ process;

Documents to be submitted:
Bidders shall include the following document in their quotation:

  • Annex 2: Quotation Submission Form duly completed and signed
  • Company Profile (Extract from the Public Registry)
  • Company Portfolio
  • Statement of satisfactory Performance (Reference Letter) from largest clients
  • Note: Bidders must prepare quotation based on the Drawing provided by RUD 

Quotation validity period: Quotations shall remain valid for 90 days from the deadline for the Submission of Quotation 

Price variation: No price variation due to escalation, inflation, fluctuation in exchange rate, or any other market factors shall be acceptable at any time during the validity of the quotation after the quotation has been received. 

Payment Terms: Post payment. The payment will be performed after receipt of goods/services, works and/or services and submission of payment documentation (subject of negotiation)

1) Could you please share the RFP (RFQ) process timetable? Dates for Bidder Queries submission, Client’s Responses, Award Date, etc. 2) Could you please share the overall Project Schedule (planned milestones, phase durations)? 3) Could you please share the estimated Budget for the Project? 4) Could you please share a draft of a Contract planned to be designed at the award? 5) Could you please share the type of procurement planned for the construction works? Lump-sum one Main Contractor? 6) Should we understand that the “Affection Plan”, 1.4.2. (a) of Annex 1, are the Drawings “TBILISI MALL CONSTRUCTION DOCUMENTATION PHASE SUBMISSION”, dated 22.08.22? 7) There is no indication on Standards and Codes in the submitted drawings, 1.4.4. (a) and 2.3 (c) of Annex 1 refer to many standards an codes, thus could you please advise whether there is precedence order? 8) We understand that the Client requires the Consultant to take full responsibility of designs (whether already produced by others, and/or to be produces by others, and/or to be produced directly by the Consultant) – which is not a typical approach. Could you please advise on whether the Consultant will be required to correct and redraw any defects in the design during the Phase 1, see 2.3 of the Annex 1. 9) We understand that the Client wishes to receive a lump-sum price to be divided as monthly payments for the Supervision Phase (2), see 2.4 of Annex 1, which is not typical approach. Could you please share the intended or planned duration for this Phase? 10) We understand that the Client requires (see 2.4.1 of Annex 1) the Consultant to take responsibility for numerous aspects, such as design by others, applied technology, logistics, consequences of Works, dust protection, compliance of performed Works, obtaining approvals from authorities, etc. – which are impossible for any Consultant to undertake, as these responsibilities (except for design, which could be incorporated into the Consultant’s scope of work) are risks to be borne either by the Contractor or by the Client, which could be managed by the Consultant. We kindly suggest a revision of this paragraph. 11) Could you please enlist the nominated specialists by the Client, their scope of services and terms of engagement, see 2.4.4 of Annex 1? 12) Could you please clarify who will be accountable for the interim payment certificates processing and review, Variation orders, determinations, or any other cost related processes within the Engineer position, in relation with the cost manager and quantity surveyor of the Employer, see 2.4.12 of Annex 1? 13) Could you please confirm that the Consultant will be required to adjudicate claims submitted by the Contractor (2.4.16 of the Annex 1) – which we understand as Contractual Adjudication? 14) Could you please advise what Services are required of the Consultant for litigation and arbitration (2.4.16 of Annex 1)?

1. It may take from 2 to 4 weeks to announce the winner (in RFQ it is indicated that the prices are valid for 90 days so that should be considered as a time for decision making) 2. We do not have exact time schedule of the project. Our request as it was stated in RFP of mall renovation is 8 months, it will be provided from contractor company who will be awarded for renovation works. Major scope of works in brief is the following: Phase 1: Floor tiles replacement (about 20000sqm) – old tiles demolishing, surface repair/preparation, new tiles placing and grouting, expansion joints arrangements (in tiles), dust distribution prevention measures, waste removal; Phase 2: vertical elements decorations – tile + metal works (including FB hiding), dust prevention measures; Phase 3: gypsum board works (ceiling (selected areas) + vertical panels) – installation, plastering, painting – dust distribution preventive measures; Phase 4: lighting replacement (including cabling) (selected contractor). Phase 5: columns’ aluminum cladding replacement (alucobond panels). All phases can be done in parallel way, Phases 1-3 and 5 can be under one contractor, works to be done in maximum number of shifts (to save the time), noisy works to be done at night time. 3. The budget is a subject of negotiations with a contractor. 4. This will be either three parties FIDIC contract (“red book”): contractor – consultant – employer or separate contract for construction supervision with bid winner. 5. Tiles for the Renovation are procured by mall and it’s in progress, materials will be delivered during January 2023 on site, one contractor will perform all Construction works including procurement of consumable materials etc. and another contractor will organize light fixture installation works 6. Affected Plans are the drawings attached to tender. Details of the plan will. Be developed together with a contractor 7. Georgian Standards and codes must be used 8. Drawings were developed by architect company. Variations to be performed by supervision of the Consultant together with Architect company. Construction company who will perform the works will be responsible for as-built documentation. Consultants’ role is to make notes, prepare sketches etc. regarding the changes which must be delivered to contractor for further update of as-built documentation. 9. Main target of consultant is to finish mall renovation within 8 months and within approved budget. Fee payment structure should motivate Consultant for the best performance with regard the time of the project and budget. Proper formula should be offered by the bidder. 10. 2.4.1 is the main responsibilities of the Consultant. If there will be some delays from the side of the construction company, consultant should compare the data and escalate it to the client for further actions. Yes, Consultant will be fully responsible for the actions and it’s consequences that are under full control of the Consultant. It will require deep communications of the Consultant with Client and Contractor both on daily basis. 11. Any specialist required for the project realization (study, expertise, etc.) to be hired by Consultant after approval with the Client (Employer). 12. Contractor will present to the Consultant a volume of performed/completed works. This activity will allow Consultant to monitor the time of project realization and the budget of the project. Consultant will control and confirm the volume of performed works to the Client (Employer) for payment purposes. Any delays to be immediately reported to the Client / Employer. In addition Consultant together with a Contractor should propose the measures to reduce the delays 13. 2.4.16 clearly states that contractor should minimize the risks for prolongation of the project and prevent additional costs requirements from contractor’s 14. 2.4.16 – the service of the Construction Consultant for the Client, in case of litigation, to analyze necessary and sufficient measures had been taken to avoid negative consequences on the project.
